UAE Workplace Privacy Laws Protect Employee Mental Health and Medical Records

Legal and compliance specialists clarified that employee medical history, psychiatric evaluations, and therapy records remain confidential under UAE privacy provisions. Employers cannot legally demand disclosure of these records even when addressing declining workplace performance. For sick leave under UAE Labour Law, workers are only required to provide official medical certificates without disclosing specific diagnoses.

Legal and compliance specialists outlined employee data protection rights and workplace privacy limits under current UAE laws on October 17, 2026. Under statutory privacy provisions, an employee's medical history, psychiatric evaluations, and therapy records remain strictly confidential.

Employers do not possess the legal authority to demand the disclosure of private medical records, even in instances where they are addressing an employee's declining work performance.

For statutory sick leave applications under the UAE Labour Law, workers are required only to furnish official medical leave certificates. They are not required to provide detailed private diagnosis records. Additionally, insurance usage data and corporate medical benefit access remain protected against unlawful employer scrutiny.
