UAE Updates E-Invoicing Regulations and Sets Deadlines for Large Enterprises

The UAE Ministry of Finance has introduced Ministerial Decisions No. 168 and No. 197 of 2026, clarifying compliance rules and provider accreditation for the national e-invoicing programme. Enterprises with annual revenues of AED 50 million or more must appoint an accredited service provider by 30 October 2026, ahead of the mandatory launch on 1 January 2027. The new rules also allow cross-border invoice data storage and introduce a temporary 24-month exemption for formal VAT Tax Group transactions.

The UAE Ministry of Finance clarified regulatory compliance rules following the implementation of Ministerial Decisions No. 168 and No. 197 of 2026, which took effect on 1 October 2026. The official register of fully accredited e-invoicing service providers reached 69 firms following voluntary pilot phases launched on 1 July 2026. Under the updated framework, businesses generating annual revenues of AED 50 million or more must appoint an accredited provider by 30 October 2026, while the mandatory operational launch date for this group remains set for 1 January 2027.

Ministerial Decision No. 168 of 2026 replaced Ministerial Decision No. 64 of 2025, completely eliminating the preliminary pre-approval status for service providers. Providers must now pass eligibility checks, interoperability testing, end-user verification, tax data reporting tests, and production readiness to obtain accreditation. Providers that held pre-approval under the previous framework received a 30-day window from 1 October 2026 to satisfy the new criteria or face termination of their preliminary approval.

Ministerial Decision No. 197 of 2026 amended Ministerial Decision No. 243 of 2025, introducing four specific adjustments. Transactions between members of the same formal VAT Tax Group are excluded from e-invoicing for 24 months, running from 1 January 2027 through 31 December 2028. The decision also removed the requirement to store electronic invoices exclusively within the UAE, shifting compliance to retrievability under the Tax Procedures Law, subject to sector-specific data retention rules such as those set by the Central Bank.

Additionally, the Ministry repealed the requirement for businesses to notify the Federal Tax Authority within two business days of an e-invoicing system failure, though standard obligations to issue and transmit invoices correctly remain in force. The general issuance deadline under Article 6(5) was shifted from 14 calendar days to 14 business days; however, VAT-registered issuers remain bound by VAT Law timelines, which generally mandate tax invoice issuance within 14 calendar days from the date of supply.

For entities with annual revenues below AED 50 million and in-scope government entities, the provider appointment deadline is 31 March 2027. Mandatory e-invoicing will commence on 1 July 2027 for smaller enterprises and on 1 October 2027 for in-scope government entities.
