Law firm Clyde & Co published an insight examining employer obligations regarding health, safety, and environment (HSE) and workforce continuity across the Gulf. The analysis noted that regional conflict has broadly affected workforces, placing critical pressure on personnel operating in energy, infrastructure, and maritime sectors.
Citing a BBC report detailing more than 20,000 seafarers stranded for months near the Strait of Hormuz facing security threats and fatigue, Clyde & Co emphasized that statutory duty-of-care obligations under UAE and Saudi Arabian laws extend to offshore environments and international waters, governed by applicable contracts and maritime legal frameworks.
Under UAE and Saudi legal frameworks, Clyde & Co highlighted that HSE injury claims can extend beyond physical harm to psychological and mental health impacts. Employers face potential labor claims for unsafe conditions, civil liability under respective Civil Codes if harm is established, and potential criminal liability in cases involving clear negligence and serious harm.
The law firm advised businesses to go beyond minimum statutory compliance by implementing risk mitigations, maintaining documented compliance records, and planning post-deployment support such as structured reintegration, extended rest periods, and psychological counselling programs.
