Legal authorities and labour specialists in the United Arab Emirates published clarifications on October 16, 2026, regarding the legal enforcement of non-compete clauses under Federal Decree-Law No. 33, according to a report by Gulf News.
Under Article 10 of the UAE Labour Law, employers are permitted to include non-compete clauses in contracts only when an employee has access to trade secrets or sensitive client data. To remain legally valid, the restrictions must specify reasonable limitations concerning geographical scope, the specific line of business, and the duration of the restriction.
Legal experts confirmed that violating a non-compete clause does not result in an automatic administrative labour ban imposed by authorities. Instead, aggrieved employers must file contractual disputes through the judiciary and prove actual financial damage in court.
