UAE Ministry of Finance Caps E-Invoicing Non-Compliance Fines at Dh50,000

The UAE Ministry of Finance has introduced updated rules capping administrative penalties for electronic invoicing violations at Dh50,000 over 12 consecutive months. The amendment also eliminates penalties previously imposed on businesses for failing to report system failures. The revised framework aims to reduce compliance burdens ahead of the mandatory nationwide rollout scheduled for October 1, 2027.

The UAE Ministry of Finance has updated the penalty framework for violations of electronic invoicing regulations following a decision by the UAE Cabinet, The National reported. The amendments are intended to provide greater regulatory certainty, reduce administrative burdens on businesses, and prevent duplicate penalties.

Under the revised rules, an initial fine of Dh5,000 ($1,360) applies for a record-keeping violation, followed by an additional Dh5,000 for each subsequent month that the non-compliance continues. However, aggregate fines for such violations are now capped at a maximum of Dh50,000 over any 12 consecutive months.

The updated regulations have also abolished administrative fines for failing to notify the Federal Tax Authority of a system failure or malfunction. This exemption applies to both invoice issuers and invoice recipients to ensure penalties remain proportionate to the responsibilities of different system participants.

Under the national framework, structured electronic invoices must be exchanged digitally between buyers and sellers and reported online to the Federal Tax Authority. A pilot phase and voluntary adoption commenced in July, with full nationwide implementation scheduled for October 1, 2027.
